Patentability of Computer-Implemented Inventions in the Area of
Computer Security

Abstract:
This lecture sets out to present the current European practice with
respect to patentability of Computer-Implemented Inventions (CII) in
Europe from the perspective of a patent examiner at the European
Patent Office. Following a brief introduction of the patent system in
general, the substantive patentability requirements set out in the
European Patent Convention will be presented with a focus on relevant
provisions concerning CIIs. The current interpretation of the broad
provisions in the law will be explained based on landmark case law.
Finally, the borderline between patentable and excluded software
related inventions will be illustrated by way of practical examples.
Bio:
Erik Veillas joined the European Patent Office in 2002. His tasks at
the EPO include carrying out prior art searches and examining European
and International patent applications in the technical area of
computer security and examining oppositions to patents granted in this
area. Prior to joining the European Patent Office, Mr Veillas has
worked four years as patent examiner at the Swedish Patent and
Registration Office, where he performed similar tasks in the technical
areas of computer architecture, computer arithmetics, information
retrieval, database management, and compilers. Mr Veillas passed the
European patent attorney Qualification Exam (EQE) in 2007 and holds an
Engineering degree in Aeronautical Systems and Services from the
French "Ecole Nationale de l'Aviation Civile".
